Overview of User Types:
- All Users: Upon joining Choowi, all users are automatically enrolled as Choowi affiliates. However, not all users have the same affiliate privileges.
- Business Users: Business users automatically have the ability to earn store credit as commissions when they refer customers to Choowi.
- Personal (Basic) Users: Personal (basic) users, while still affiliates, do not have the ability to earn store credit commissions. Instead, they can use the affiliate system to upgrade to VIP status free of charge by referring three or more people.
1. Acceptance of Terms
Before creating a Choowi account and becoming a Choowi affiliate, it’s essential to carefully read and understand the terms and conditions outlined in this agreement. By proceeding to create your account or continuing to use our services, you are indicating your acceptance of these terms.
2. Application Review
Choowi retains the right to review and approve or decline any account at our sole discretion. If your account is rejected or deleted at a later date, there are no grounds for appeal.
3. Earning Commissions
a. Commission Structure: As a Choowi business account holder and affiliate, you have the opportunity to earn commissions when individuals make purchases on Choowi’s platform through your referral link or coupon code. Commissions are typically rewarded in the form of store credit unless an alternative arrangement is agreed upon in writing.
b. Active Referrals: To qualify for commissions, the referred accounts must remain active for a minimum of 31 days. It’s essential that your referrals genuinely engage with Choowi’s products or services.
c. Prohibited Self-Referrals: You are not permitted to refer yourself or create fictitious accounts to artificially inflate your earnings. Any such attempts will result in the cancellation of all related accounts.
4. Sharing Links and Coupons
Affiliates are encouraged to share their unique affiliate links and coupons, but within certain boundaries:
- Authorized Sharing: Affiliates can share their affiliate links and coupons on their personal/business social media profiles, with their friends, and with their double opt-in email subscribers.
- Anti-Spam Policy: Spamming tactics, such as mass email campaigns or widespread newsgroup postings, are strictly prohibited. Affiliates must promote Choowi responsibly and ethically.
- No Fake Accounts: Creating fake accounts to share your url and generate referrals is against our policy and will lead to account termination.
5. Honest Promotion
Affiliates must promote Choowi honestly and transparently. Misleading claims or false advertising are not permitted. Your promotions should accurately represent Choowi’s products and services.
6. Termination
This program holds affiliates to high standards of conduct. Choowi reserves the right to suspend or terminate your affiliate status for any of the following reasons:
- Inappropriate advertisements containing false claims or misleading links.
- Engagement in spamming activities, including mass emails or forum posts.
- Promoting or associating with illegal activities.
- Violation of Choowi’s intellectual property rights. If you intend to use Choowi’s trademarks, you may be asked to provide licensing agreements to protect our intellectual property.
- Offering incentives like rebates or coupons as part of your affiliate commission, except for the bundling of other products with Choowi.
Additionally, Choowi may terminate any affiliate account for violations of this agreement or for any other reason at our discretion.
7. Liability
Choowi will not be held responsible for indirect or accidental damages, such as loss of revenue or commissions, arising from issues related to affiliate tracking failures, database file losses, or any malicious intent toward the program or our website.
We make no guarantees about the error-free operation of the program or our website and shall not be liable for any interruptions or errors.
8. Duration
This agreement takes effect when your affiliate account is created and will continue until your affiliate account is terminated. Choowi reserves the right to modify the terms and conditions of this agreement, and if you find any modifications unacceptable, your only option is to terminate your affiliate account. Your continued participation in the program implies your acceptance of any changes.
9. Indemnification
Affiliates are responsible for indemnifying and holding Choowi, its affiliates, and subsidiaries, along with their officers, directors, employees, licensees, successors, and assigns, harmless from any liabilities, damages, fines, judgments, claims, costs, losses, and expenses, including reasonable legal fees and costs, related to actions taken under this agreement, including negligence, misrepresentation, failure to disclose, or intentional misconduct.
10. Agreement as an Electronic Contract
By signing up for Choowi, you electronically acknowledge and accept the terms and conditions of this agreement. This electronic signature holds the same legal weight as a handwritten signature.
